Our Terms and Conditions define the rules and guidelines for using Diastolix's services and accessing our content.

1. Agreement to Terms

By downloading or using the Diastolix application (the “Services”), you acknowledge that you have read and agree to these Terms and Conditions, along with our Privacy Policy. If you do not agree to all of these terms, you must not use the app or Services. These Terms constitute a binding legal agreement between you (the user) and Diastolix. Your use of Diastolix confirms your acceptance of these Terms and your agreement to abide by them in full.

2. Additional Terms

In some instances, additional terms or policies may apply to specific features, promotions, or services offered through Diastolix. For example, if we offer a contest, promotion, or integration with another platform, that activity may be subject to supplemental terms (“Additional Terms”). Any such Additional Terms will be provided to you and are hereby incorporated into this agreement by reference. In the event of a conflict between these Terms and any Additional Terms, the Additional Terms will control for that specific service or feature. By using those features, you agree to the applicable Additional Terms.

3. Use of Services

Eligibility: 

You must be at least 16 years old to register and use the Diastolix Services. If you are under 18 years old (i.e. a minor in most jurisdictions), you may use Diastolix only with the consent and supervision of your parent or legal guardian. By using and registering for Diastolix, you represent that you meet this age requirement. The Services are not intended for children under 13 years of age, and Diastolix does not knowingly allow anyone under 13 to create an account or use the app. If you are under the minimum age required by law in your jurisdiction to consent to digital services (which may be older than 13 in certain regions), you may not use the Services.

Account Registration: 

To access most features of Diastolix, you will need to create a user account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You should not share your username or password with anyone, and you must notify us immediately at our support contact (see Section 21) if you suspect any unauthorized use of your account or any other security breach. You may not create multiple accounts for the same person, and you may not transfer your account to anyone else without our permission. Diastolix will not be liable for any loss or damage arising from someone else using your account, with or without your permission.

User Responsibilities: 

In using the Services, you agree to use Diastolix only for its intended purposes (personal health tracking and wellness management) and in compliance with all applicable laws and regulations. You must provide truthful information and refrain from any misrepresentation of identity or health data. If we have grounds to believe that any information you provided is untrue, inaccurate, or incomplete, we may suspend or terminate your account. You are responsible for all activity on your account.

4. Subscriptions and Payments

The features of Diastolix are offered on a premium or subscription basis (“Subscription”). If you enroll in a Subscription, you authorize Diastolix (or the app store platform) to charge you the disclosed subscription fees on a recurring basis (e.g. monthly or annually) until you cancel. Subscriptions will automatically renew at the end of each billing period unless you cancel beforehand. To avoid being charged for the next period, you must cancel your Subscription at least 24 hours before the next renewal date. If you do not cancel in time, the subscription will automatically renew and the applicable fees will be charged using your selected payment method 24 hours prior to the start of the new subscription period.

Cancellation Policy: 

You may cancel your Subscription at any time. Cancellation will take effect at the end of the current billing cycle. This means you will retain access until the end of the period you already paid for, but you will not receive a prorated refund for the remainder of the period (unless required by law or expressly stated otherwise). To cancel, you should use the account settings in the app or the platform (such as the Apple App Store or Google Play Store) through which you subscribed. 
Please note: If you do not cancel at least 24 hours before the renewal, the subscription will still renew for the next term and you will be responsible for the associated charges. After cancellation, you will not be billed for further periods.

Changes to Subscription Terms: 

Diastolix reserves the right to adjust pricing, content, and other terms of Subscriptions. For example, we may change the subscription fee or add/remove features. If we do so, we will provide advance notice of material changes (such as by an in-app notification or email) and the new fees or terms will apply from your next billing cycle. If you do not agree to a change, you must cancel your Subscription before the next billing date. If you continue to use the Subscription after the change takes effect, you will be deemed to have accepted the new terms and charges. We will not make changes to your subscription mid-cycle without your consent; changes will only apply to future subscription periods.

Promotional Offers: 

Diastolix may periodically offer free trials or promotional subscription offers to new or eligible users. Any such offer is provided at our discretion and is subject to these Terms and any additional terms that are presented with the offer. For example, a free trial may be offered for a specified period (e.g. 7 days or 14 days). Unless you cancel before the end of the trial period, when the trial ends your subscription will automatically convert to a paid Subscription and your payment method will be charged the applicable fee

We will inform you of the terms of any free trial or promo, including when it will convert to a paid plan. Promotional offers cannot be combined (unless expressly permitted) and are limited to one per user. We reserve the right to modify or revoke a promotional offer at any time, subject to applicable law. If you violate these Terms, any promotional offer or discounted rate may be invalidated and your account may be charged the regular fees for continued use of the Subscription.

5. Payment Terms

Payment Methods: 

You agree to pay all fees and charges associated with your use of any paid Services (such as subscription fees) in a timely manner. Diastolix accepts various payment methods (e.g. credit/debit cards, or payments through the Apple App Store / Google Play). You must provide a valid payment method at the time of purchase or subscription. By providing a payment method, you represent that you are authorized to use that payment method and you authorize Diastolix (or its third-party payment processor) to charge that method for all fees incurred. This includes recurring subscription fees, one-time purchases, taxes, and any other charges described. If your payment method is through a third-party app store, you will be billed in accordance with the app store’s policies, and those payments are handled by that third party.

Non-Refundable Policy: 

Except as expressly provided in these Terms or as required by law, all payments are final and non-refundable. Fees and charges (including subscription fees) are generally non-refundable once paid, except where required by law. Please be sure you want to subscribe or purchase before completing a transaction.

Recurring Billing: 

By signing up for a Subscription, you acknowledge that it has recurring payment features and you accept responsibility for all recurring charges before cancellation. We will continue to bill your chosen payment method on a recurring basis (e.g., monthly or annually) for the subscription until you cancel. If we cannot collect payment (due to expiration, insufficient funds, or otherwise), we may attempt to charge any other payment method you have provided or ask you to provide a new payment method. Failure to pay fees when due may result in suspension or termination of your Subscription.

Payment Failure and Collection: 

You are responsible for ensuring that your payment information is current and accurate. If a payment is not successfully settled (for example, due to credit card expiration or insufficient funds) and you do not cancel the Subscription, we may suspend your access to the paid Services until payment is received. We reserve the right to retry charging your payment method at a later time or invoice you for the unpaid amount. If you remain in arrears of payment, Diastolix reserves the right to revoke or terminate your access to paid features. You agree to reimburse us for any reasonable costs we incur in collecting overdue amounts, including attorneys’ fees and collection agency charges, except where prohibited by law. Diastolix also reserves the right to report delinquent payments to credit bureaus or pursue legal action, as appropriate.

Billing Disputes: 

If you believe you were charged in error, please contact our support team within a reasonable time (such as 30 days of the charge) so we can review your account. We will investigate any disputed charge, and if we find an error on our side, we will correct it or issue a refund as appropriate. To the fullest extent permitted by law, you waive all disputes not reported within 60 days of the charge, after which the charge will be deemed final and indisputable.

6. User Content and Ownership

User Content: 

Diastolix allows you to input and store personal health information and other content (collectively, “User Content”) for your tracking and convenience. This may include your blood pressure readings, pulse, symptoms, notes, medical history details, profile information (such as age or weight), or other data you choose to enter. You retain ownership of any User Content that you submit, post, or store through the Services

Diastolix does not claim ownership of your personal health data. However, in order for us to operate and improve the Services, you grant Diastolix a license to use your User Content. Specifically, by submitting or uploading User Content, you grant Diastolix a worldwide, non-exclusive, royalty-free, fully-paid, transferable and sublicensable license to use, reproduce, distribute, modify (for technical adaptations, such as formatting), display, and perform your User Content as needed to provide the Services and as otherwise explained in our Privacy Policy. This license is solely for the purpose of enabling Diastolix to operate, maintain, and enhance the Services (for example, to display back to you your logged data, to analyze and give you insights, to back up your data, or to troubleshoot issues you report). We will not share your personal User Content with other users or the public without your direction or consent.

User Content Responsibility: 

You are solely responsible for all User Content that you provide or generate in using Diastolix, and for ensuring it’s lawful and accurate. You acknowledge that you have all necessary rights and permissions to upload or share the information that you provide (for example, if you include information about another person, you should have their permission). Diastolix is not liable for any User Content that is provided by you or others, and we do not guarantee the accuracy, integrity, or quality of any such content. While Diastolix has no obligation to monitor User Content, we reserve the right to remove or disable access to any User Content for any reason, including if we believe, in our sole discretion, that it violates these Terms or applicable law. You understand that any User Content you delete from the app may persist in backup copies for a reasonable period of time (but will not be available to others).

No Sensitive Personal Information via Support: 

Except for the health and personal information you intentionally log in the app, please do not send us other sensitive personal information (like social security numbers, credit card info, etc.) when communicating with support. If you do, it’s at your own risk and not necessary for use of the Service.

Ownership of Diastolix Materials: 

All content and materials provided by Diastolix through the app or Services (excluding your User Content) are the property of Diastolix or its licensors. This includes the software, design, data compilations, aggregated reports, text, graphics, logos, images, and all other elements of the app (“Diastolix Materials”). These are protected by copyright, trademark, and other intellectual property laws. As between you and Diastolix, Diastolix retains all rights, title, and interest in and to the Services and Diastolix Materials. You are granted no ownership or intellectual property rights in the Services or Diastolix Materials by virtue of using our app, aside from the limited usage license granted in Section 9 below.

7. Data Collection and Privacy

Your privacy is very important to us. Our practices regarding your personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to read the Privacy Policy carefully, as it explains what data we collect, how we use it, and how we safeguard it. By using Diastolix, you consent to the collection and use of information about you as outlined in the Privacy Policy. Key points include:

Data We Collect: 

Diastolix collects personal data that you provide to us (such as your name, email, age, etc.) as well as health and wellness data you log (such as blood pressure readings, heart rate, symptoms, medications, notes, and other inputs). We may also collect device and usage information automatically, like device type, operating system, app usage metrics, and location (if you grant permission). All of this information is collected and processed in accordance with applicable privacy laws and with your consent where required.

How We Use Your Data: 

We use your information to provide and personalize the Services, to analyze and send you health insights, to maintain and improve the app’s functionality, and to communicate with you (for example, sending reminders or responding to support requests). We may also use aggregated, de-identified data (which cannot identify you personally) for research or product improvement purposes. Protecting your data is a priority: we implement appropriate technical and organizational measures to secure your personal information. This includes using encryption (e.g., TLS) for data in transit and other industry-standard security practices. However, you understand that no method of transmission or storage is 100% secure, and we cannot guarantee absolute security of your information. You use the Services and provide data at your own risk, and you should take steps to secure your account (such as using a strong password).

Compliance with Privacy Laws: 

Diastolix is designed to comply with relevant privacy regulations, including (where applicable) the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), among others. If you are in the European Economic Area (EEA) or other regions with laws governing data collection and use, we will ensure that your personal data is processed in accordance with those laws. For example, if we collect any “special” categories of personal data (like health data subject to GDPR), we will obtain your explicit consent for that processing. You have certain rights regarding your personal data, which are explained in the Privacy Policy (such as the right to access or delete your data, subject to legal exceptions).

Third-Party Data Sharing: 

We do not sell your personal information to third parties. We may share your data with third-party service providers who help us operate and provide the Services (such as cloud hosting providers, data analytics services, or customer support tools), but only for purposes of supporting our Services and under strict obligations of confidentiality. These providers are contractually required to protect your information and use it only for the services they perform for us. In addition, we might share limited data when necessary to comply with a legal obligation or enforce our rights (for example, responding to a lawful subpoena, or preventing fraud or abuse). If Diastolix ever undergoes a business transaction like a merger or acquisition, user data may be transferred to the successor entity under the same privacy commitments.

Health Data & Third-Party Integrations: 

If you choose to connect Diastolix with third-party health platforms (for example, importing data from Apple HealthKit or Google Fit), any data imported will be treated as User Content under these Terms and as personal data under our Privacy Policy. We will only access or transfer such data with your permission. Likewise, if you export or share data from Diastolix to another service, that third-party’s terms and privacy policy will govern the use of that exported data.

By using Diastolix, you agree that we can collect and use your information in accordance with our Privacy Policy and these Terms. If you have questions about our data practices, you can contact us via the information in the Privacy Policy or Section 21 below.

8. Health and Medical Disclaimer

The Services are solely for informational purposes and are not intended to replace professional medical advice, diagnosis, treatment, or prevention of any disease or medical condition. Diastolix is not a licensed medical care provider and does not engage in the diagnosis, examination, or treatment of medical conditions. Users should always consult their doctor or another qualified healthcare professional regarding any health concerns or medical conditions.

Diastolix does not offer emergency services and is not responsible for initiating contact with emergency responders, healthcare professionals, or medical institutions on behalf of users. Users should not delay seeking professional medical advice or treatment based on information provided through the Services.

You acknowledge that no doctor-patient relationship is established between you and Diastolix by using the app. The app’s outputs (such as notifications that a reading is high or tips for wellness) are not individualized medical diagnoses or treatment plans. If you have an emergency or acute medical issue (for example, symptoms of a heart attack or stroke, or any condition that you feel is urgent), call emergency services or your doctor immediately – do not rely on the app. Diastolix may provide general wellness information, but it cannot and does not guarantee that any particular reading or symptom is normal or benign. 

In summary, Diastolix is not a substitute for professional medical judgment. You agree that Diastolix is for personal monitoring and informational purposes and is not intended to diagnose, treat, cure, or prevent any disease. Any health-related information provided by Diastolix is not exhaustive and may not cover all diseases, ailments, physical conditions or their treatment. Your reliance on any information provided by the app is solely at your own risk.

9. Intellectual Property

Ownership of the Services: 

The Diastolix Services (including the app, website, and all content and materials available within them, other than User Content) are owned by Diastolix (Diastolix Inc.) and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. This includes all software code, design elements, text, graphics, logos, icons, images, audio clips, video, algorithms, compilations of data, and the overall look and feel of the app. All rights, title, and interest in and to the Services and content remain with Diastolix and/or its licensors. You are granted no ownership rights in the Services by using them. The Diastolix name and logo are trademarks/service marks of Diastolix. All other product or company names mentioned in the app may be trademarks of their respective owners. Nothing in these Terms grants you any license or right to use any trademark or logo of Diastolix or any third party, unless you obtain our prior written consent.

Limited License to You: 

Subject to your compliance with these Terms, Diastolix grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use our mobile app and to access the Services for your own personal, non-commercial use. This license is solely so that you can use and enjoy the Services in the manner permitted by these Terms. You agree not to copy, reproduce, distribute, publicly perform or display, or create derivative works of any part of the Services or content provided by Diastolix (other than your own User Content) without our prior written consent. You also may not reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. All rights not expressly granted to you in these Terms are reserved by Diastolix and its licensors. If you violate the license terms, it may result in termination of your right to use the Services (see Section 12) and may also constitute infringement of Diastolix’s intellectual property rights.

Feedback: Please see Section 20 regarding any feedback or suggestions you provide to us, and how Diastolix may use them.

10. Prohibited Conduct

You agree to use Diastolix in a lawful and respectful manner. You must not misuse the Services or use them in a way that causes harm to Diastolix or anyone else. In particular, and without limitation, you agree not to do any of the following when accessing or using Diastolix:

  • Break the Law: Use the Services in any manner that violates any applicable law, regulation, or court order, or for any unlawful or fraudulent purpose. This includes (but is not limited to) laws relating to data privacy, export control, intellectual property, and medical or health information.

  • Post Illegal or Harmful Content: Upload, transmit, or share any content that is illegal, harmful, violent, defamatory, obscene, hateful, or otherwise objectionable, or that violates the rights of any third party (such as content that is invasive of privacy, or infringes copyright or other intellectual property rights). Since Diastolix primarily involves personal data entry rather than public posting, this applies to any content you might input that is not your information to share (for example, don’t upload someone else’s medical records without permission) or any misuse of communication features if provided.

  • Impersonation and Misrepresentation: Impersonate any person or entity, or falsely claim an affiliation with any person or entity. You must not misrepresent your identity or provide false information on the app. This includes not creating accounts under a fake name or for someone else without authorization.

  • Unauthorized Access: Attempt to gain unauthorized access to any portion of the Services, to other users’ accounts or data, or to any of Diastolix’s computer systems or networks connected to the Services. You shall not interfere with or circumvent any security or authentication measures of the Services. Any form of hacking, password “mining”, or other illegitimate means of accessing or using the Services is strictly prohibited.

  • Automated Access and Scraping: Do not use any robot, spider, scraper, crawler, script, or other automated means to access, data-mine, extract data from, or otherwise interact with the Services without our express prior written permission. The app is meant to be used via our provided interface. Automated querying or mass data extraction (e.g., scraping blood pressure data en masse from our systems) is not allowed, except as permitted by an API or integration that we explicitly offer under separate terms.

  • Disruption of Service: Do not engage in any activity that could disrupt, overburden, damage, or impair the proper operation of the Services or the servers and networks used in providing the Services. This includes not sending or introducing any viruses, worms, malware, Trojan horses, or other harmful code into the app, not performing denial-of-service attacks, and not engaging in any other conduct that interferes with our systems or infrastructure or with any other user’s experience.

  • Reverse Engineering and Tampering: You will not decompile, reverse engineer, disassemble, or attempt to derive the source code or underlying ideas or algorithms of any component of the Services (except as permitted by law). Likewise, you must not modify, adapt, or hack the app, or attempt to bypass any technological measure (such as encryption) used to protect data or restrict access to parts of the Services.

  • Unauthorized Commercial Use: Use the Services for any commercial or advertising purpose (aside from use of the app for your personal health tracking) without our prior written consent. This means you should not resell the Services or any part of the content to others, or use the app to solicit other users or advertise third-party products. The Services are provided for personal, non-commercial use only. 

  • Harassment or Misuse: You agree not to harass, abuse, or harm other individuals while using our Services. If the app eventually includes social or community features (forums, etc.), you will follow any community guidelines and not engage in bullying, stalking, or any behavior that is threatening or harmful to others.

  • Any Other Harmful Activities: Engage in any other activity that we have specifically prohibited in any other sections of these Terms or that we, in our discretion, determine to be harmful to other users, to Diastolix, or to the Services’ integrity.

This list of prohibitions is not exhaustive. Any conduct that we determine (in our reasonable judgment) restricts or inhibits anyone from using or enjoying Diastolix, or which threatens the security, stability, or integrity of our Services, may result in suspension or termination of your access. If you violate any of the above rules, we may take action including removing offending content, warning you, suspending or terminating your account, and/or involving law enforcement if the behavior is unlawful.

11. Third-Party Services and Links

The Diastolix app may contain links or integrations to third-party websites, products, or services that are not owned or controlled by Diastolix. For example, we might provide links to educational health content, or allow you to connect Diastolix with other health apps or devices. Please note that when you access third-party services, their terms and privacy policies will govern your use of those services, not ours. Diastolix is not responsible or liable for the content, practices, or offerings of any third-party websites or services, even if accessed via our app. We provide these links or integrations only as a convenience to you.

When you click a third-party link or enable a third-party integration, you do so at your own risk. Third-party sites may collect data or solicit personal information from you. We do not make any representations or warranties about the content or security of third-party sites. Inclusion of a link or integration in our Services does not imply endorsement by Diastolix. You acknowledge and agree that Diastolix shall not be responsible for any damage, loss, or liability caused or alleged to be caused by or in connection with your use of any third-party services. If you have any issues or disputes with a third-party service (for instance, if an integrated device malfunctions or a linked article has incorrect information), you should address those with the third party directly.

However, if you encounter a broken link or something problematic in a third-party integration from within our app, we’d appreciate you letting us know so we can consider removing or fixing it. Your feedback helps us maintain a high-quality experience.

Third-Party Login or App Store: If you download Diastolix from a third-party app store or use a third-party authentication (like signing in via Google or Apple), you must also comply with all applicable terms of those third parties (e.g., Apple App Store Terms or Google Play Terms). Those third parties are not parties to these Terms and generally do not sponsor or endorse our Services.

12. Termination and Account Suspension

By User (You): 

You have the right to stop using the Services at any time. You may delete the Diastolix app from your device and, if you wish to permanently close your account, you may use any account deletion option in the app (if available) or contact us at our support email to request account deletion. If you simply stop using the app without deleting your account, we may retain your information for a period, after which it may be deleted or anonymized in accordance with our data retention practices.

By Company (Diastolix): 

Diastolix reserves the right to suspend or terminate your account or access to the Services at any time, for any reason, with or without notice. We may do so if you violate these Terms, if we suspect fraudulent or unlawful activity, if you engage in behavior that is harmful to other users or the Service, or if we cease offering the Services. We also may terminate accounts that have been inactive for an extended period of time (for example, if an account has not been accessed or the user has not logged in for over 3 months). Diastolix shall not be liable to you for any compensation, reimbursement, or damages in connection with any termination or suspension of your account or access to Services, whether for cause or without cause.

Effect of Termination: 

Upon termination of your account by you or by us, your right to use the Services will immediately cease. You must discontinue all use of the app and destroy any copies of the app in your possession. Any provisions of these Terms which by their nature should survive termination (such as ownership provisions, disclaimers of warranty, indemnities, and limitations of liability, and dispute resolution agreements) will survive. If your account is terminated or suspended by us due to your breach of these Terms, we reserve the right to deny any re-registration attempt by you under a new account unless we provide written consent.

If at any time you terminate your account or we terminate it and you have an active Subscription, you may or may not be entitled to a prorated refund for the unused portion of that subscription, depending on our refund policy and applicable law (see Section 5). Termination of your account will not waive or affect any accrued rights or obligations owed to either party up to the date of termination.

13. Limitation of Liability

To the maximum extent permitted by law, Diastolix, along with its affiliates, licensors, service providers, and suppliers, shall not be held liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to these Terms or your use of the Services. This applies regardless of whether Diastolix has been advised of the possibility of such damages.

The total liability of Diastolix for any claims arising from or in connection with the Services or these Terms shall be limited to the total amount you have paid to Diastolix for the Services, without any minimum amount specified.

Please note that certain jurisdictions do not permit the limitation or exclusion of liability for incidental or consequential damages. In such cases, some of the above limitations may not apply to you.

14. Binding Arbitration for Dispute Resolution

Please Review Carefully:
By agreeing to these Terms, both you and Diastolix agree to resolve most disputes through binding arbitration on an individual basis, rather than through court proceedings or class actions.

Arbitration Agreement

Any dispute, claim, or controversy arising from or related to these Terms or your use of the Services, including those related to privacy and data security, will be resolved through binding arbitration. Both parties retain the right to bring individual claims in small claims court or seek court relief for intellectual property issues. Arbitration will be conducted individually, not as a class action or other collective proceeding.

Opt-Out Option

You may opt out of this arbitration agreement by providing written notice within 30 days of agreeing to these Terms. To opt out, send a notice to Diastolix at [support email] with your full name, mailing address, and a statement of your decision to opt out of arbitration.

Arbitration Process

Before initiating arbitration, the party must attempt to resolve the issue informally by contacting the other party. If you have a dispute with Diastolix, send a written notice to Diastolix’s registered agent at [Insert Contact Information] or via email at [Insert Support Email]. The notice must include your name, contact details, a description of the dispute, and the specific relief sought. If unresolved after 30 days, either party may initiate arbitration.

Arbitration will be managed by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The process may occur in person, by phone, or online, and the arbitrator may grant any relief available in court but only to the extent necessary to resolve the individual dispute.

Enforceability

If any part of this arbitration agreement is found to be unenforceable, that portion will be severed, and the remaining agreement will remain effective. If a dispute must be resolved in court, it will be handled in the appropriate courts within the designated jurisdiction.

15. Applicable Law and Jurisdiction

These Terms, along with any disputes arising from or related to these Terms or the Services, will be governed and interpreted under the laws of the State of California, without consideration for its conflict of law principles. If any dispute is not resolved through arbitration, the parties agree that such disputes will be addressed exclusively in the appropriate state or federal courts, and both parties consent to the jurisdiction and venue of those courts.

16. Service Modifications and Termination

If you are using our mobile app on an Apple Inc. (“Apple”) device, the following terms apply. These Terms, including this section, serve as a customized End User License Agreement (EULA) for any Diastolix app, fulfilling Apple's requirements, and replacing Apple’s standard EULA.

Agreement Between You and Diastolix:

These Terms form an agreement solely between you and Diastolix, not with Apple. Diastolix is entirely responsible for the mobile app and its content, as far as Apple is concerned.

License Scope:

You are granted a non-transferable license to use the Diastolix app on any Apple-branded device that you own or control, in line with the App Store Terms of Service.

Maintenance and Support:

Diastolix is solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide such services.

Warranty Obligations:

Diastolix is responsible for any warranties associated with the app, as permitted by law. If the app does not meet these warranties, you may notify Apple for a refund (if applicable). Beyond that, any further warranty responsibilities rest with Diastolix.
